BOOKING TERMS & CONDITIONS

Adventure & Landscape, E.V.T. leg 14351 (owned by Andes en Llamas SRL) and referred to as A&L in this document, agrees to the following Terms & Conditions with the client. It is imperative that these are read carefully and fully understood before booking. These Terms & Conditions constitute a binding contract between A&L and the client, for the services provided by A&L. By booking with us and paying the non-refundable 20% deposit or full payment for the services you have requested, you acknowledge that you have read and understood and that you agree to these Terms & Conditions.

INSURANCE: Adventure & Landscape requires that you take a suitable comprehensive medical and travel insurance prior to trip departure. It must cover accidents, medical costs and repatriation, as also the costs for loss of baggage, hurt or theft. It must be appropriate for your age, nationality and appropriate for the country (s) you are travelling in.

WEATHER: All tours may be cancelled or modified if weather conditions do not allow the proper functioning or safety of the tour.

RESPONSIBILITY AND RISK ACCEPTANCE FORM: Guests must sign a responsibility and risk acceptance form prior to participating in some activities. Guests who are 18 years and older sign their own responsibility and risk acceptance form. Guests under the age of 18 must have a parent or legal guardian sign on their behalf. The Responsibility and Risk Acceptance Form is a legal document and signing it means you have read and understood the form.

LIMITATION OF LIABILITY: A&L acts as a booking agent in matters relating to hotel and lodge accommodation, tours and other independent contractors providing transportation and/or other services, each of which is an independent corporation outside A&L’s control and each of which has its own terms and conditions. As such, A&L shall not be liable for injury, delays, loss or damage in any manner. A&L reserves the right to employ sub-contractors for all or part of its services; in the event of such right the terms of this clause apply.

Whilst every care is taken, A&L cannot be held responsible for loss or damage to baggage. We do not assume responsibility for airlines and accommodation providers or for any loss, damage, death, injury or expense (including loss of money paid in advance), which you may incur as a consequence of the acts and omissions of others. A&L will not accept responsibility or liability if you contravene any law or regulation of any country or region visited. Any independent arrangements that you make that are not part of the A&L trip (including pre- and post- trip accommodation and travel services) are entirely at your own risk and A&L cannot and does not give you any assurance, representation or warranty in connection with any such arrangements.

PRIVACY: A&L does not use your private information for anything other than booking activities and tours with A&L or any of our third-party activity suppliers. A&L does not share your information with other companies. Our team is committed to protecting your privacy and using technology with the most secure online experience possible.

BOOKING & PAYMENT: Once we agree on your itinerary and price, we will send a Pro-Forma with quote, trip details and payment instructions. We maintain blocked services without payment of deposit for one week (if 59 days prior to trip departure) or two weeks (if 60 + days prior to trip departure). To book and confirm services we require a 20 % deposit, as per the quote in the Pro Forma. The balance should be paid 40 days prior to trip departure. If booking is made within 40 days of trip departure date, then the full amount is payable at the time of booking.

BANK WIRE AND CREDIT CARD FEES: A&L shall not be responsible for wire transfer or credit card charges.

International airfares, passport and visa fees, travel insurance, excess baggage charges, airport taxes, gratuities to leaders and guides, extra meals, laundry, extra & alcoholic drinks, or any expenses incurred that are not included in the trip quote, medical expenses, optional activities and trips, and other items of a personal nature are not included in your trip price.

CANCELLATION & REFUNDS: All cancellations must be made by email with the name of trip/travellers + TRIP CANCELLED in the Subject line, and are effective upon confirmed receipt in our office. Refunds take 2 to 3 weeks to process.

Fees to apply in case of cancellation:

Up to 41 days prior to the departure 20 % of the trip price

Less than 40 days 100 % of the trip price

Depending on the circumstances of cancellation we can use the trip deposit for future travel within 6 months of the original trip departure date. When A&L books services – such as hotels, transportation or third-party products – we operate as per each supplier’s cancellation policy.

CHANGES TO YOUR TRIP: Local conditions in Latin America countries are not always predictable and from time-to-time delays and diversions from the planned itinerary could happen. Should such an instance happen, A&L shall do its best to minimize inconvenience. However A&L does not accept any responsibility or compensation for delays, loss or extra expenses resulting from circumstances or events beyond A&L control.

COMPLAINTS: If you have any complaint about your trip, you must make it known at the earliest opportunity to the guide, trip leader and/or A&L local representative, who will normally be able to take appropriate action. If at the end of the trip you feel your complaint has not been properly dealt with you must notify us in writing within 30 days of the end of your trip.

TRAVELLER INFORMATION

CURRENCY FLUCTUATION: Currencies fluctuate constantly. Therefore, and in the case of exceptional cost increases beyond our control, it may be necessary for us to modify the tour cost any time before departure if there are significant changes in the exchange rate or increase of costs beyond our control due to inflation. Any changes in price will be explained clearly to you when made.

PASSPORT AND VISAS: It’s the travellers’ responsibility to carry a valid passport and have obtained the appropriate visas when traveling with A&L. Please ensure that your passport is valid for 6 months beyond the duration of your holiday. A&L shall not be responsible for any delay, interruption or cancellation resulting from client’s failure to provide required documentation to immigration or other authorities at any time. HEALTH, FITNESS AND AGE LIMITS: Travellers must advise A&L of any pre-existing medical condition and/or disability that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a tour and the enjoyment of other trip members. A&L trips are designed for adults (18 to 75 years old), 16 and 17 year old guests are accepted if travelling with a parent or legal guardian.

MOUNTAIN ALTITUDE: Some of our active trips take place at altitudes you may not be used to. Extreme altitude is inherently risky, so proper medical advice should be sought in good time before booking if partaking in activities such as mountain climbs or high altitude hikes and treks (usually above 3,500 m.a.s.l.).

SPECIAL REQUESTS: Clients should advise A&L of any special request (for example: special diet or on account of physical disability) at the time of enquiry or submitting a reservation. A&L will do its utmost to meet such requests wherever possible.

GOVERNING LAW: This agreement will be governed by and construed in accordance with the Law of Argentina and each party agrees to submit to the exclusive jurisdiction of the courts of Argentina as regards any claim or matter arising under this agreement.

Please note that your final itinerary may vary slightly from the one described in the website as we continuously research and develop each trip, customizing your experience to match your interests and tastes. Inclement weather—though we’d like to think there won’t be any—may also

require minor itinerary alterations.
